Section 3 of DOMA, the Defense of Marriage Act, violates the equal-protection rights of individuals who are married to individuals of the same sex, because it defines "marriage" as "a legal union between one man and one woman," and "spouse" as "a person of the opposite sex who is a husband or a wife."
