APPEALINGLY BRIEF! (with Dan Klau)
In the immortal words of the Independence Day character who flew his F-18 fighter jet into the death ray of a gigantic alien spacecraft as it was about to destroy Area 51, Hello Boys, I'm Baaack! Now, I can guess what most of you are thinking: Who cares? A fair thought, I must concede. It has been several years since I wrote my last column on appellate practice for the Law Trib and, unlike the hue and cry that went up when Norm Pattis stopped writing for a while (and justly so), the end of my column was met with . . . well, uh, silence. A humbling experience, but good for keeping my ego in check. Recent events have rekindled my desire to share my thoughts on appellate law, practice and procedure. This time, however, the vehicle for communicating my thoughts will not be limited to the written word. You see, the wife and kids gave me a camcorder for my birthday. That gift, coupled with a few hours learning how to use iMovie (Apple Computer's simple video editing program), led me to reach out to the Law Trib with a new idea: a multi-media column. Instead of limiting my self to the traditional written word, the column-which will be accessible through the Law Trib's website-will also incorporate video podcasts. Appealingly Brief! will be a monthly series of 2-3 minute-long video presenting a tip or commentary on appellate law and practice. To the greatest extent possible, I will try to avoid the dreaded talking head approach used in so many do-it-yourself videos. Instead, I'll strive to present each tip in a more memorable and, hopefully, humorous way. In between monthly episodes of Appealingly Brief!, my colleague in appellate crime, Rich Wareing, will also join me in Wareing v. Klau-a series of short video debates on topical legal matters. Rich tends to have a more conservative approach to issues, while I tend to be slightly left-of-center. We hope you find our mini-debates informative and entertaining. I hope this new column will find favor with the Law Trib's readers. Take a look in the coming weeks and tell me, Rich, or the Trib, what you think. I look forward to your comments and suggestions. |
