A court can approve a municipality's request to demolish a building that allegedly violates building codes and zoning regulations and require that the building's owner pay demolition costs and attorneys' fees. The plaintiff municipality sued the defendant preservation society, alleging that the defendant's property violates the state building code and municipal zoning regulations. The defendant was defaulted, and the court granted the municipality permission to demolish the residence. The court granted the municipality permission to enter the residence and to remove personal property, if any. The court ordered the preservation society to cooperate with the municipality, when the municipality applies to the municipal inland-wetlands agency for permission to demolish the structure. The court fined the preservation society $10 per day, retroactive to the first day of the alleged violations, and ordered the preservation society to pay the town $500 for installing a fence around the perimeter of the property, any costs to remove personal property, storage costs and costs associated with the demolition. The court also ordered the preservation society to pay attorneys' fees of $3,221.
