Nestico v. Weyman
A dental malpractice action was properly dismissed for failure to comply with the requirements of Connecticut General Statutes §52-190a, which pertain to the filing of a good faith certificate with the complaint and a signed opinion of a similar health care provider. Leah Nestico filed this dental malpractice action against Brett Weyman and Connecticut Maxillofacial Surgeons, LLC. The trial court granted the defendants motion to dismiss the action for failing to comply with the requirements of C.G.S. §52-190a. The plaintiff appealed challenging the decision. The Appellate Court affirmed the judgment and adopted the trial court's decision as a proper statement of the relevant facts, issues and applicable law finding further discussion unnecessary.
