Lebby v. Radshaw
Absent good cause, failure to file an answer to a grievance complaint within 30 days can result in a reprimand. The complainant, Cecelia Lebby, filed a grievance complaint on May 3, 2012, and the complaint was forwarded to the respondent attorney, John Radshaw, on May 8. The respondent attorney did not file an answer to the grievance complaint within 30 days. The respondent failed to establish good cause for his failure to respond timely. The Statewide Grievance Committee found, by clear and convincing evidence, that the respondent attorney failed to file an answer to the grievance complaint timely, in violation of Rule 8.1(2) of the Rules of Professional Conduct. "[T]he Respondent's participation in the disciplinary process," wrote the Statewide Grievance Committee, "is an important . . . responsibility." The Statewide Grievance Committee reprimanded the respondent attorney.
