Berka v. City of Waterbury
A court can fine a resident who allegedly violates a city ordinance. The City of Waterbury alleged that the defendant, George Berka, placed garbage on a sidewalk and obstructed the sidewalk, in violation of a city ordinance. Ordinance §99.40 requires that residents inform the Department of Public Works, 24 hours in advance, prior to placing certain types of garbage in a pick-up area. The city submitted a picture of the subject garbage. The court credited the city's evidence that George Berka allegedly violated the ordinance that requires that residents refrain from obstructing the sidewalk. The court fined George Berka $100. The city failed to prove that Berka did not keep his premises free of litter, and the court denied the city's request to fine Berka an additional $100.
